Trump administration asks Supreme Court to enforce mail‑ballot rules before midterms

In a decisive move to protect the upcoming November elections, the Trump administration filed a new appeal with the Supreme Court on Sunday. The petition asks the high court to stay a preliminary injunction issued by U.S. District Court Judge Indira Talwani, which currently prevents the United States Postal Service from enforcing several new mail‑ballot requirements.

Administration’s rationale

Solicitor General John Sauer emphasized that ballots have already begun to be mailed in states such as North Carolina, with Alabama slated to start on September 9 and at least five additional states set to begin the week of September 13. “Once those ballot envelopes enter the mailstream, there is no retrieving them,” Sauer warned, adding that the injunction risks “sowing confusion and chaos” as more states move forward with their mail‑in processes.

The administration maintains that the rule is a lawful, modest exercise of rulemaking authority delegated by Congress to the Postal Service. It regulates the handling of U.S. Mail, not the conduct of federal elections. The rule requires federal election ballots sent through the mail to use envelopes bearing the official Election Mail logo, meet automation standards, and carry unique barcodes. State election officials would also need to submit envelope designs for review and provide the Postal Service with information about intended ballot recipients.

Protecting the mail system and election security

According to the filing, these requirements are intended to improve the handling and delivery of ballot mail and to protect the mail system from being used to facilitate voter fraud. The rule does not give the Postal Service authority to decide who may vote by mail, nor does it dictate how ballots are counted—responsibilities that remain with state and local election officials.

Democratic‑led states and voting‑rights groups have challenged the restrictions, claiming they are unconstitutional. Election officials in several states argue there is insufficient time to revise their systems before the November deadline. The administration disputes those arguments, noting that Congress gave the Postal Service broad authority to regulate mail handling and that the rule does not interfere with ballot content, voter eligibility, election deadlines, or counting procedures.
