Tribal Gaming Commission Lacks Chairperson

The National Indian Gaming Commission, which oversees the $46 billion tribal gaming industry, is unable to enforce laws and regulate casinos due to a lack of a chairperson. The last chairperson stepped down in January, and President Donald Trump has not nominated a replacement.

Impact on Tribal Casinos

The vacancy is affecting tribal casinos, including the Iowa Tribe of Oklahoma’s new Harrah’s-branded casino in Chandler, Oklahoma. The tribe’s chairman, Jacob Keyes, said that the casino’s management agreement with Harrah’s parent company is stalled due to the commission’s inability to approve it.

The commission’s lack of enforcement power is also a concern, as it is unable to cite casinos for violating federal law or force the emergency closure of unsafe facilities. Industry leaders say that this could discourage investment in tribal gaming and slow business growth.

Prediction Markets Pose Threat to Tribal Gaming

The commission’s vacancy comes as online prediction markets, such as Kalshi and Polymarket, are emerging as a new threat to tribal gaming. These platforms allow users to wager on the outcome of events, and tribal leaders fear that they could violate their sovereignty and take a bite out of gaming revenue.

At least eight tribes have sued prediction market platforms, alleging that they accept bets from tribal lands and in states where tribes have exclusive gaming rights. The commission’s silence on the issue has been noted, with some attributing it to the Trump administration’s support of the prediction markets industry.
