A family is planning legal action after their 1-year-old child, Vincent Fiordilino, was declared dead at an Arizona hospital, only to be found alive in the morgue. The child was found face down in a pool during a Super Bowl party and was transported to a nearby hospital, where he was pronounced dead by Dr. Toosi.

However, the child’s mother and a nurse detected signs of life in the following minutes, and bodycam footage recorded Dr. Toosi declaring the child dead. The police report noted that the child was ‘still possibly breathing based on the appearance of his stomach and chest area rising and falling.’ When this information was brought to Dr. Toosi, he responded ‘arrogantly’ and said he was the doctor and had the medical degree.
Medical officials later found the child breathing and carrying a pulse just before midnight at the morgue. He was then flown to Phoenix Children’s Hospital, where it was confirmed he was suffering from severe medical issues related to the near-drowning. The child’s kidneys, lungs, and liver began shutting down after he arrived at the hospital, but later testing found no brain damage.
The family has set up a GoFundMe drive to support the child’s recovery, which will require extensive therapy, ongoing medical monitoring, and treatment. Neither Dr. Toosi nor the parents have been charged with a crime in relation to the incident.
