TikTok Agrees to $400 Million Settlement Over Child‑Privacy Violations

The U.S. Justice Department announced Friday that TikTok and its parent ByteDance have reached a $400 million settlement in a federal child‑privacy case. The agreement resolves allegations that the video‑sharing app gathered personal information from millions of users younger than 13 without the required notice or consent of their parents, a violation of the Children’s Online Privacy Protection Act (COPPA).

Settlement Details

Under the terms of the deal, TikTok will pay $300 million immediately. An additional $100 million will be payable only if a federal court later vacates a 2019 consent decree that was imposed on Musical.ly, TikTok’s predecessor, for similar violations. The Justice Department said the settlement ranks among the largest recoveries ever achieved in a COPPA case.

Federal Complaint Background

The Department of Justice filed the civil suit in the U.S. District Court for the Central District of California in 2024 after receiving a referral from the Federal Trade Commission. The complaint alleged that TikTok knowingly allowed children under 13 to create standard accounts, use adult‑oriented features, and submit personal data without parental notice or consent. It also claimed the company frustrated parents who requested deletion of their children’s accounts, citing a sample of roughly 1,700 accounts where about 500 remained active after complaints were filed.

According to the complaint, TikTok’s internal systems and employees often failed to reliably identify underage accounts for deletion, affecting millions of users, though an exact total was not provided.

Government Response

Associate Attorney General Stanley E. Woodward Jr. called the settlement “a major victory for American children and parents.” The Justice Department emphasized that the agreement resolves the allegations only and does not constitute a finding of liability. The department also noted that TikTok has since strengthened safeguards for younger users, improved age‑verification controls, and expanded parental oversight tools.

State‑Level Action in Texas

Separately, Texas Attorney General Ken Paxton (R) filed a state lawsuit in January 2025 accusing TikTok of deceptively marketing the app as safe for children while downplaying the presence of explicit content. That case, filed under the Texas Deceptive Trade Practices Act, focuses on marketing and content‑safety claims and remains distinct from the federal COPPA settlement.

What This Means for Parents

While the settlement does not admit wrongdoing, it signals a heightened federal focus on protecting children’s online privacy. Parents are encouraged to review TikTok’s updated age‑gate features and parental‑control settings, which the company says have been expanded since the lawsuit was filed.

Looking Ahead

The $100 million contingent payment hinges on a court order that would vacate the 2019 Musical.ly consent decree. If that occurs, TikTok’s total financial responsibility could reach the full $400 million figure. The settlement also serves as a reminder to other technology firms that federal regulators will continue to enforce COPPA requirements vigorously.
