Thailand Enacts Political Amnesty Law Excluding Lese Majeste Cases

Bangkok – A Thai legislative committee approved the Peaceful Society Promotion Act, which went into force on Monday, offering amnesty for political offenses committed between Jan. 1, 2005 and July 15, 2025. The law is intended to foster national reconciliation after years of protests, coups and violent clashes.

Scope of the Amnesty

According to estimates presented in Parliament, the measure could affect roughly 6,000 individuals. It will release current prisoners, terminate ongoing investigations, dismiss pending court cases and expunge criminal records for those deemed eligible.

However, the act expressly excludes several serious categories: offenses under Article 112 of the Criminal Code (commonly known as lese majeste), corruption, and crimes that resulted in death or serious injury. Critics argue that leaving out lese majeste cases—punishable by up to 15 years in prison—undermines the law’s promise of true national healing.

Les​e Majeste Controversy

Article 112 has been a focal point of Thailand’s political debate. The provision allows any citizen to file a complaint alleging defamation of the monarchy, often leading to lengthy detention even for minor online activity such as “liking” a social‑media post. Since early 2020, Thai Lawyers for Human Rights reports that more than 290 people, many of them student activists, have faced charges under the law. As of July, at least 54 remain incarcerated for political cases, though only about ten are expected to benefit from the new amnesty because the rest are accused of lese majeste.

The law’s exclusion of these cases has drawn sharp criticism from pro‑democracy groups, who say the amnesty will not resolve the underlying political divisions that have plagued the country for over a decade.

Political Background

Thailand’s political landscape has long been shaped by tension between former Prime Minister Thaksin Shinawatra’s populist base—strong in the rural north and northeast—and the urban elite, royalists and the military. Thaksin was ousted in a 2006 military coup, and subsequent governments have oscillated between civilian rule and military intervention.

Student‑led protests that began in 2020 called for reforms to the lese majeste law, arguing that it is used to silence dissent. The government’s decision to retain the law within the amnesty framework signals a continued commitment to protecting the monarchy’s status, a cornerstone of Thailand’s conservative political establishment.

Implementation Process

The act was published in the Royal Gazette on Sunday. A committee chaired by the prime minister will determine eligibility, with its first meeting required within 30 days. The timeline for processing applications remains unclear.

While the amnesty may provide relief for thousands of political detainees, the exclusion of the most serious offenses suggests that Thailand’s path to lasting reconciliation will remain contested.
