Supreme Court’s Election Rulings Cause Chaos

The US Supreme Court’s recent rulings on election laws have caused chaos and criticism from experts, who argue that the court is unevenly applying its own principles. The court’s conservative majority has been accused of disregarding the Purcell principle, which states that federal courts should not order major changes close to an election to limit voter confusion.

Purcell Principle Under Fire

The Purcell principle was first articulated in the 2006 case Purcell vs. Gonzalez, and has been used to guide the court’s decisions on election laws. However, experts argue that the court is now wielding the principle unevenly, allowing last-minute election changes in Southern states that hold major consequences for the future of Black political representation in the region.

Wilfred Codrington III, a professor of law at the Benjamin N. Cardozo School of Law, said that the court’s actions are causing voter confusion and undermining the integrity of the electoral process. ‘The court has not thought through the implications of its decisions, and it seems like when the court applies them, they’re being applied in partisan ways,’ Codrington said.

Court Legitimacy at Stake

The court’s recent decisions have sparked criticism from several high-profile observers, including Steve Vladeck, a professor of law at the Georgetown University Law Center, who wrote that the court’s actions ‘fatally undermine’ the animating purpose of the Purcell principle. Rick Hasen, a professor at UCLA School of Law and director of the Safeguarding Democracy Project, wrote that the Supreme Court has become a ‘chaos agent’ in elections.

The court’s legitimacy is at stake, with public support for the Supreme Court dropping prior to the recent decisions. An August 2025 Pew Research Center survey found that 48% of Americans hold a favorable view of the court, a 22-percentage point drop from August 2020.
