Legislative Issues
One key issue NFIB is addressing is stopping lawsuit abuse in the state. Two bills are currently being tracked that aim to curb lawsuit abuse and reduce liability insurance increases in Michigan: Premises Liability Reform and Third Party Litigation Funding. The Premises Liability Reform bill, House Bill 4582, seeks to reinstate the “open and obvious” doctrine standard for premises liability cases, which was eliminated by the Michigan Supreme Court in 2023. The Third Party Litigation Funding bill, House Bill 5281, aims to protect Michigan small businesses from lawsuit lending, which allows outside investors to profit from lawsuits with little transparency or oversight.
