The loophole was created in 2001 when the Supreme Court ruled that illegal immigrants could be released from detention after six months if no country accepted them for deportation. Britt’s bill, the Keeping Our Communities Safe Act, would expand the Department of Homeland Security’s authority to detain criminal aliens and limit the availability of bonds unless an illegal immigrant can establish by clear and convincing evidence that they are not a flight risk or a risk to another person or the community.
The bill has been circulating in Congress since 2011 and has 11 Senate Republicans on board as co-sponsors. Sen. Tommy Tuberville, R-Ala., stated that the Biden administration allowed millions of illegal immigrants to enter the country, and now law-abiding Americans are paying the price.
