Sen. Dan Sullivan condemns federal judge’s block of King Cove road project

Alaska Senator Dan Sullivan (R‑Alaska) issued a statement on Friday after a U.S. District Court judge ruled against a proposed land exchange that would allow construction of a single‑lane, 11‑mile gravel road connecting the remote community of King Cove with Cold Bay, home to an all‑weather airport. The road is intended to provide reliable emergency medical access for King Cove residents.

Judge blocks land exchange

The court’s decision cited the land exchange’s failure to meet requirements under Title XI of the Alaska National Interest Lands Conservation Act, the Endangered Species Act, and the National Wildlife Refuge System Improvement Act. The ruling overturns a prior decision by Interior Secretary David Burgum, which had found the exchange balanced environmental concerns with public safety needs.

Senator Sullivan’s response

Senator Sullivan described the ruling as a “shameful betrayal” of King Cove’s people. He said the judge “regularly sides with Lower 48 environmental groups” and accused national Democrats of supporting “far‑left radical environmental groups” that have opposed the land exchange for decades. Sullivan noted that at least 18 residents of King Cove have died while awaiting medical care because of the lack of a reliable road.

“I was recently in King Cove, where we held a community‑wide town hall,” Sullivan wrote. “The excitement of finally being able to start construction of this road brought tears to the eyes of many.” He pledged to continue fighting for the road, emphasizing its importance for the safety and well‑being of Alaska Natives.

Background on the road project

The proposed road would link King Cove, a small fishing community of roughly 1,000 people, to Cold Bay Airport, which provides year‑round air service and medical evacuation capabilities. Supporters argue the road is essential for emergency medical transport, fire response, and economic development. Opponents, primarily environmental groups, contend the project could harm protected wildlife habitats and violate federal conservation statutes.

Legal and constitutional considerations

The ruling raises questions about how federal environmental statutes intersect with constitutional rights to life, liberty, and the pursuit of happiness. Sullivan’s statement highlighted the tension between protecting wildlife and ensuring access to life‑saving medical services for nearly a thousand Alaskans.

Legal analysts note that the case may be appealed, potentially bringing the dispute to a higher federal court. The outcome could set precedent for how infrastructure projects in remote areas are evaluated under federal environmental law.

Community impact

King Cove residents have expressed frustration and disappointment at the decision, emphasizing the road’s role in reducing travel time for medical emergencies from several hours by boat or plane to a matter of minutes by vehicle. Local leaders continue to advocate for the project, citing both safety and economic benefits.

The state government has not yet indicated its next steps, but officials say they will work with federal agencies and the courts to explore alternative pathways for the road’s construction.
