Rocket Lab protests NASA’s $700 million Mars Telecom Contract Award to Blue Origin

Rocket Lab, the private launch provider based in New Zealand and the United States, lodged a formal protest on September 11 with the Government Accountability Office (GAO) over NASA’s recent award of a $700 million contract to build, launch and operate a Mars Telecommunications Network. The contract was given to Blue Origin, a competitor founded by Jeff Bezos.

Congressional eligibility requirements at issue

According to Philip Metzger, a planetary scientist at the University of Central Florida and director of the Stephen W. Hawking Center for Microgravity Research, the law that authorized the project specified which companies could bid. “Congress passed a law that authorized this project, and Congress was really specific about what companies would be allowed to bid on the contract,” Metzger said. “They had to already have done a study on a Mars sample return, and they had to have already bid a Mars telecommunications relay as part of that.” He added that Rocket Lab believes it is the only company that satisfied those criteria.

Rocket Lab’s allegations

In its GAO filing, Rocket Lab argues that NASA’s award decision is inconsistent with the eligibility criteria mandated by Congress. The company also contends that NASA’s technical review of Rocket Lab’s proposal was punitive and contained incorrect assumptions. “NASA’s award decision appears to be inconsistent with the eligibility criteria mandated by Congress,” the protest states. “In addition, the agency’s punitive review of Rocket Lab’s technical volume was inconsistent, making incorrect assertions and conclusions. Procurement standards exist to ensure fair competition and protect public investment. We are pursuing this review to ensure those standards are upheld for critical infrastructure that will underpin American exploration at Mars for decades to come.”

Blue Origin’s contract and timeline

NASA announced the award to Blue Origin on September 1. The contract calls for a Mars Telecommunications Network orbiter that would support both robotic and future human missions, providing navigation, science payload capacity and the ability to deploy additional landers. Blue Origin’s design includes 13 ports for scientific instruments and other payloads.

Industry reaction

Research chemist Ken Kremer, who works on the project, said the mission should proceed as quickly as possible. “It is very important that this mission get launched as quickly as possible to Mars,” Kremer said. “They want to have this ready to hand to NASA, this Mars telecommunicator orbiter, by the end of 2028 so they can launch in the next launch window.” He expressed a desire to see the budget accommodate both companies, noting that competition could drive better value for taxpayers.

Potential outcomes

Metzger noted that there have been a few cases since 2007 where a protestor ultimately won a contract after a government procurement review was found to be flawed. “It’s possible that Rocket Lab could win this,” he said. “There have been two or three cases since 2007 where the party that complained ended up winning because the government didn’t follow the correct procurement rules.”

Responses from the parties

When contacted for comment, Rocket Lab’s corporate and launch communications director declined further remarks beyond the official statement already released. Attempts to reach Blue Origin and NASA for comment did not yield a response at the time of publication.

What’s next?

The GAO will review Rocket Lab’s protest and issue a decision on whether NASA must reconsider the award. If the protest is upheld, NASA could be required to re‑evaluate the bids or reopen the competition, potentially delaying the Mars Telecommunications Network schedule. If the protest is denied, Blue Origin will move forward with development and launch preparations, aiming for a 2028 delivery to support upcoming Mars missions.
