Predominantly white Wall Street executives who engineered risky mortgage practices avoided criminal prosecution, even as the nation suffered massive foreclosures and economic decline. In contrast, minority executives have faced intense public vilification when their firms encounter difficulties.

Recent case: First Brands Group

First Brands Group, an Ohio‑based auto‑parts manufacturer founded by immigrant entrepreneur Patrick James, provides a current example. James built the company by acquiring legacy brands such as FRAM, Trico, and Raybestos, keeping jobs in the Midwest instead of moving production overseas. When high‑interest private financing and a post‑pandemic economic slowdown strained the company, federal prosecutors in the Southern District of New York invoked the “Financial Kingpin” statute—originally designed for drug cartels—to pursue a lengthy prison term for James.

Critics argue that the prosecution serves the interests of private lenders who financed the expansion, rather than protecting American workers. The resulting liquidation eliminated thousands of jobs and handed market share to foreign competitors.

Calls for fair treatment

Advocates stress that equal application of the law is essential for a thriving economy and a just society. They point to the need for consistent standards that protect both investors and the American workforce, regardless of a leader’s race or background.

While the case proceeds before U.S. District Judge Analisa Torres, observers hope the courtroom will focus on the merits rather than a narrative driven by bias.
