Oklahoma lawmakers push back on state education department’s cut to third‑meal funding

State Sen. David Bullard, a Republican from Oklahoma, warned that the Oklahoma State Department of Education (OSDE) lacks legal authority to eliminate federal funding for an expanded learning‑time third‑meal program. Bullard said the agency’s decision could force the state into costly litigation and jeopardize the program for the remainder of the school year.

Letter gathers bipartisan support

Bullard authored a letter, now signed by more than 50 lawmakers, urging the OSDE to halt the cut. The legislators argue that the department cannot unilaterally change the criteria schools must meet to qualify for the federal reimbursement.

Department cites USDA recommendation

State Superintendent Lindell Fields told KOCO 5 that the OSDE’s action follows a recommendation from the U.S. Department of Agriculture. A recent USDA review found that some participants in the third‑meal option were not complying with federal guidelines.

Lawmakers question priorities

Bullard questioned why the department was focusing on this issue instead of other pressing concerns, asking, “Why is this all of a sudden the major focus that you’re willing to die on the sword for when we have so many other issues?”

Deadline for after‑school programs

Schools have until Oct. 1 to establish qualifying after‑school programs or risk losing the funding. The change will not affect the 56 districts that already operate at‑risk after‑school programs meeting federal standards.

Potential legal battle

If the OSDE proceeds, Bullard said the state could face a lawsuit that would cost taxpayers additional dollars in court fees. He emphasized that protecting the funding is essential for families who rely on the additional meal option during extended learning hours.
