New Law Seeks Transparency in San Francisco Rental Fees

San Francisco is taking steps to address the issue of hidden rental fees that can significantly increase the cost of housing for tenants. With the city’s median rent for a one-bedroom apartment reaching $4,000, Supervisor Bilal Mahmood is introducing legislation to ensure transparency in rental costs.

Legislation for Transparency

The proposed law would require landlords to disclose all additional fees, such as those for pest control or garbage, that are not included in the quoted rent. These fees can increase a renter’s monthly costs by 10 to 30 percent, according to the Urban Institute Initiative. Mahmood’s legislation aims to provide renters with a clearer picture of their financial commitments by mandating that apartment listings on platforms like Craigslist and Zillow include an estimated all-in monthly cost.

If a fee is not disclosed, tenants would be protected from eviction for non-payment of that fee. Additionally, the legislation would allow tenants to terminate their lease without penalty if a landlord fails to properly disclose fees.

Impact on Housing Stability

Ora Prochovnick, director of litigation and policy at the Eviction Defense Collaborative, supports the legislation, highlighting that unexpected fees often lead to evictions for renters with tight budgets. The law is expected to help tenants budget more effectively, which is crucial for those living paycheck to paycheck.

The legislation aligns with similar transparency efforts in other industries, such as airline and hotel pricing. Mahmood believes that by revealing the true cost of renting, the market may adjust, potentially leading to lower rents.

Broader Housing Affordability Efforts

This initiative is part of Mahmood’s broader efforts to tackle housing affordability in San Francisco. Other proposals include a ban on using building shadows to block new housing construction and a reduction in transfer taxes for properties valued over $10 million. These measures are pending approval by the Board of Supervisors.

Mahmood hopes the fee-disclosure law will prevent renters from considering unaffordable apartments and contribute to a more stable housing market. The legislation is set to be introduced on June 9, with a hearing expected in July.
