Elon Musk’s artificial intelligence company xAI is challenging a Minnesota law that restricts access to technology used to create realistic nude images, known as ‘nudification’. The law, set to take effect, prohibits operators of websites, apps, software, and other services from allowing users to create such images or videos of identifiable individuals.

First Amendment Concerns

xAI’s lawsuit alleges that the law is too broad and violates the First Amendment’s right to freedom of speech. The company argues that the law’s penalties are too steep and that it improperly targets platforms rather than the individuals creating the images or videos.

Minnesota Rep. Jessica Hanson, who authored the bill, responded to xAI’s lawsuit, stating that the law is necessary to protect children from sexual exploitation. ‘Nudification’s victims are overwhelmingly children and women,’ she said. ‘Child sexual abuse material has surged by 26,000% due to this tool, with fake nude images devastating lives.’

xAI is seeking reimbursement from the state of Minnesota for all legal fees related to the lawsuit and is asking the court to declare the law unconstitutional and prevent its enforcement.
