Michigan House Advances Bills to Impose Mandatory Minimums for Criminal Sexual Conduct

In Lansing, the Michigan House of Representatives has taken a decisive step to strengthen penalties for criminal sexual conduct. On Wednesday, lawmakers introduced House Bills 6260 through 6263, which were promptly referred to the House Judiciary Committee for review.

Key provisions of the package

HB 6260 – First‑degree criminal sexual conduct: A conviction would carry a mandatory minimum sentence of 15 years in prison. Current law already allows sentences ranging from several years up to life imprisonment, depending on the facts of the case. The bill does not alter existing enhanced penalties for particularly egregious cases, such as those involving victims under 13.

HB 6261 – Second‑degree criminal sexual conduct: The legislation would eliminate the present 15‑year statutory maximum and impose a minimum ten‑year prison term for any conviction.

HB 6262 – Third‑degree criminal sexual conduct: Under the proposal, the current five‑year maximum would be replaced with a five‑year minimum sentence.

HB 6263 – Fourth‑degree criminal sexual conduct: This bill would upgrade the offense from a misdemeanor to a felony, placing it under Michigan’s more serious criminal classification.

Potential impact

If the bills pass both chambers and are signed by the governor, Michigan’s sentencing framework for criminal sexual conduct would shift dramatically. Mandatory minimums would limit judicial discretion, and the reclassification of fourth‑degree offenses would expose more offenders to the state’s felony penalties, potentially deterring future crimes.

The proposals are still early in the legislative process. The House Judiciary Committee must first consider the measures before they can move to the full House for a vote. Even after passage, the bills could be amended during debate, and final approval will require the governor’s signature.

Community response

Family and faith leaders across the state have expressed strong support for tougher penalties, emphasizing the need to protect children and uphold moral standards. Critics, however, warn that mandatory minimums may reduce flexibility for judges to consider unique circumstances and could contribute to prison overcrowding.

Regardless of the debate, the legislation reflects a clear intent by the current Michigan legislature to prioritize public safety and uphold traditional family values through stricter criminal justice measures.
