Lubbock renters: 7 essential rights every tenant should know

Living in Lubbock and dealing with a difficult landlord? Knowing your rights under Texas law can keep you from being taken advantage of. Below are seven core protections that apply to renters throughout the city.

1. Landlord entry requires proper notice

Texas does not have a statewide 24‑hour notice rule, but most leases spell out when a landlord may enter the unit. Tenants are entitled to quiet enjoyment, so if a landlord is entering at all hours, review the lease to see whether the entry is permitted.

2. Repairs that affect health and safety must be addressed

Landlords are required to fix conditions that could jeopardize a tenant’s physical health or safety. Tenants should give written notice of the problem first; the landlord then has a reasonable time to make the repair, as outlined in Texas Property Code §§92.052‑92.056.

3. Utility shut‑offs are limited

In most cases a landlord cannot cut off utilities for non‑payment. Texas law only allows interruptions for emergencies or necessary repairs, per Texas Property Code §92.008.

4. Security deposits cannot be kept for normal wear and tear

Landlords may not retain a deposit simply because an apartment shows signs of ordinary use. The Texas Property Code §§92.101‑92.109 sets out how deposits must be returned and what deductions are permissible.

5. Retaliation for complaints is prohibited

If a tenant exercises legal rights or files a complaint, a landlord may not retaliate by raising rent, reducing services, or otherwise penalizing the tenant. This protection is detailed in Texas Property Code §§92.331‑92.335.

6. Evictions must follow legal process

A landlord cannot change locks or force a tenant out without going through the court‑ordered eviction process. Chapter 24 of the Texas Property Code explains the required notice periods and court filings.

7. Lease terms cannot be changed without written agreement

A lease is a binding contract. Any modifications must be documented in writing and signed by both parties. Tenants should keep copies of any addenda or amendments.

Understanding these rights helps Lubbock renters avoid common pitfalls and ensures landlords adhere to the law. For more detailed information, consult the Texas Attorney General’s renter‑rights page or review the relevant sections of the Texas Property Code.
