A federal judge has ordered the release of Maria Rosales, a 32-year-old mother from Colombia, who was arrested by U.S. Immigration and Customs Enforcement (ICE) at Logan Airport in Boston. Rosales was attempting to fly home from a concert when she was taken into custody.

Background

Rosales, a recipient of Deferred Action for Childhood Arrivals (DACA), has been living in the United States since she was four years old. Her latest DACA renewal has been stalled for three years. According to her attorney, Todd Pomerleau, Rosales is traumatized by the experience and is happy to be out of custody.

ICE claimed that Rosales overstayed a visitor visa after entering the U.S. in 1998. However, Pomerleau argued that she did not have a criminal record and was a DACA recipient. The judge ruled that the federal government must not detain her again without following the applicable statutory and regulatory procedures.

Another Arrest

Another individual, David Ardila, a 33-year-old native of Venezuela, was also arrested by ICE at Logan Airport on the same day. Ardila had an asylum petition and was in the country to attend a World Cup match. ICE claimed that he overstayed his visa and remained in the country illegally for over eight years.
