Judge Denies Special Prosecutor for Alleged ICE Misconduct in Chicago

A Cook County judge has denied a petition to appoint a special prosecutor to investigate alleged misconduct by federal immigration agents during Operation Midway Blitz in Chicago. The decision was made by Judge Erica Reddick, who found that the petitioners did not provide enough evidence to demonstrate a conflict of interest that would prevent Cook County State’s Attorney Eileen O’Neill Burke from conducting an investigation.

The petition, submitted by the Chicago law firm Loevy & Loevy, was backed by over 400 elected officials, faith leaders, and community organizations. It outlined various alleged crimes by federal agents, including the fatal shooting of Silverio Villegas González and the non-fatal shooting of Marimar Martinez, along with incidents of tear-gassing protesters.

The petitioners argued that O’Neill Burke’s office had ignored these alleged acts of violence. However, O’Neill Burke cited a 2017 Illinois Supreme Court decision that limits a state’s attorney’s ability to investigate unless other law enforcement agencies have inadequately addressed the issue or requested assistance.

Judge’s Ruling and Reactions

Judge Reddick emphasized that the responsibility for initial investigations lies with law enforcement agencies. She noted the absence of documented investigations by the Chicago Police Department into the alleged misconduct, which undermined the petitioners’ case.

Rubén Castillo, a petitioner and chair of the Illinois Accountability Commission, expressed disappointment but remained committed to seeking accountability. He mentioned efforts to encourage residents to report alleged crimes by federal agents to local police, with support from Cook County Commissioner Jessica Vasquez.

O’Neill Burke reaffirmed her office’s commitment to reviewing cases brought by law enforcement but stressed that decisions would be based on law and facts, not public pressure.

In contrast, Minnesota prosecutors have charged federal immigration agents with crimes, including assault and false reporting. Illinois State Police recently launched an investigation into the shooting of Villegas González, following calls from the Illinois Accountability Commission for local law enforcement to investigate federal agents’ actions.

Attorney Locke Bowman, representing the petitioners, vowed to continue demanding accountability from local authorities, emphasizing the importance of addressing alleged crimes in Chicago.
