Indiana Supreme Court Upholds Spencer Deery’s 3‑Vote Primary Victory

Indiana voters saw the state’s highest court step in to protect their ballots on Tuesday, confirming Spencer Deery as the winner of the razor‑thin State Senate District 23 Republican primary. The Supreme Court certified a final tally of 6,335 votes for Deery against 6,332 for challenger Paula Copenhaver, overturning a Recount Commission decision that had thrown out ballots missing required clerk stamps or signatures.

Court decision restores valid votes

Justice members heard testimony that only six contested ballots across three counties were at issue. They concluded that a lack of a clerk stamp or signature does not invalidate a voter’s choice. “The vote is the vote,” analyst Tony Katz said, calling the commission’s action “textbook disenfranchisement.”

Why the ruling matters for Hoosier voters

Katz argued that discarding legitimate ballots because of clerical oversights undermines the fundamental right to vote. He emphasized that the problem lies with the clerks, not the voters, and warned that allowing such errors to stand would set a dangerous precedent for future elections.

Both the Recount Commission and the Supreme Court acted within their legal mandates, but the episode exposed a glaring flaw in Indiana’s election statutes. Katz urged the General Assembly to clarify the rules so that administrative slip‑ups never override a citizen’s vote.

Separating the dispute from broader scandals

The recount controversy was also used by some to attack Secretary of State Diego Morales. Katz drew a clear line, noting Morales’ personal scandals—such as alleged payroll favoritism and hiring of a brother‑in‑law—are separate from the civil servants who process ballots. “The issue was always about the clerks, not Morales,” he said.

Looking ahead to November

With the court’s ruling final, attention now turns to whether Indiana lawmakers will tighten election rules before the November general election. Protecting the integrity of the ballot box, Katz said, begins with safeguarding the voters who cast those ballots.
