Independence City Council adopts new zoning rules for data centers and battery storage

Independence, Mo. – On Oct. 5 the Independence City Council voted unanimously to strengthen its Unified Development Ordinance (UDO) with specific requirements for data centers and battery energy storage systems (BESS) located within city limits. The amendments, introduced by Councilmember Brice Stewart and Mayor Kevin King, aim to safeguard residential areas, schools, parks, health facilities, and places of worship while providing clear guidelines for developers.

Key provisions of the new ordinance

• Distance requirement: Any new data center or BESS must be situated at least 1,000 feet from residences, schools, parks, recreation facilities, daycares, nursing homes, hospitals, and places of worship. Variances may be granted if recommended by the city planning commission and approved by the council.

• Noise and mitigation: Projects must submit noise‑impact assessments and mitigation plans to address mechanical noise concerns.

• Decommissioning rule: Data centers that cease operations for 12 months must be decommissioned, ensuring vacant sites do not become blighted.

• Generator reporting: Generators serving these facilities will now file compliance reports every six months rather than annually, providing more frequent oversight.

• Special‑use permits: Data centers larger than 2.5 megawatts are required to obtain a special‑use permit, adding an extra layer of review for high‑impact projects.

Why the changes matter

Independence previously lacked specific zoning standards for data processing and battery storage facilities, a gap that became evident as interest in these high‑tech developments grew. The city’s staff noted that such projects bring unique land‑use considerations, including massive electrical demand, high water consumption, on‑site backup power generation, and consistent mechanical noise. By codifying standards, the council is providing developers with clear expectations while protecting surrounding properties and community resources.

Background and community response

The city placed a moratorium on new data‑center projects in July after Nebius broke ground on a hyperscale AI data factory in the Little Blue Valley and Patmos announced plans for a facility along Little Blue Parkway. Although the council approved the Nebius project in March, organized opposition contributed to the election of new council members who opposed the development. The recent unanimous vote reflects a balanced approach: encouraging responsible economic growth while addressing resident concerns.

Local residents and business owners have expressed relief that the new rules set measurable safeguards. “We want to attract cutting‑edge technology jobs, but not at the expense of our neighborhoods,” said a longtime Independence homeowner who attended the public hearings.

Next steps

Developers seeking to build or expand data centers or battery storage facilities must now submit applications that meet the distance, noise, decommissioning, and reporting requirements outlined in the amended UDO. The city planning commission will review variance requests and forward recommendations to the council for final approval.

City officials emphasized that the amendments are designed to foster a climate of responsible innovation, ensuring that Independence remains a welcoming place for families, faith communities, and businesses alike.
