Illegal immigrant speedboat operator arrested after New York Harbor crash kills infant and mother

New York City – Immigration officials arrested Manuel Ernesto Hernandez‑Umana, a 46‑year‑old illegal immigrant from El Salvador, after a federal criminal court released him on bail for the fatal speedboat crash that occurred on August 8 in New York Harbor. The crash claimed the lives of 5‑month‑old Antonella Garcia and her 27‑year‑old mother, Sara Sanchez.

Immigration status and pending charges

According to the Department of Homeland Security, Hernandez‑Umana entered the United States through a Texas border crossing in 2007, falsely claiming U.S. citizenship to a border officer. He is currently detained at an Immigration and Customs Enforcement facility in Elizabeth, New Jersey, and Homeland Security Secretary Markwayne Mullin said he will be removed from the country after he is convicted.

In the criminal case, prosecutors allege Hernandez‑Umana caused the deaths through misconduct or neglect. He faces charges of causing death while operating a vessel without a Coast Guard license and violating safety regulations. The court scheduled his next appearance for September 9.

Details of the harbor accident

Coast Guard investigators reported that Hernandez‑Umana was piloting a 21‑foot Yamaha AR210 with 14 passengers aboard, exceeding the vessel’s 10‑person capacity. While making a U‑turn in choppy water, the boat swamped and sank more than three hours into a tour that began around 7 p.m. The infant was not provided a life preserver because the boat lacked child‑size equipment. Prosecutors say Hernandez‑Umana instructed the adult passenger to hold the infant herself, a violation of federal safety rules.

The tour was organized by Zeus Luxury Rental Inc., a company that promotes its services on Instagram and TikTok. The firm previously experienced a separate incident when a chartered boat caught fire during a birthday cruise on Long Island Sound last year.

Legal and immigration proceedings

After his bail release, Hernandez‑Umana was apprehended by immigration agents. In a statement, Secretary Mullin said, “Once he faces justice for his crimes, we will make sure that he is swiftly removed from our country.” The attorney representing Hernandez‑Umana, Amy Gallicchio, declined to comment.

During his initial court appearance on August 10, Hernandez‑Umana entered the courtroom still wearing the T‑shirt, swim trunks, and water shoes he had on during the ill‑fated voyage. He did not enter a plea at that hearing.

Community impact and safety concerns

The tragedy has raised questions about the oversight of private boat charters and the enforcement of safety standards on the water. Local officials and safety advocates emphasize the need for proper licensing, adherence to capacity limits, and the provision of life‑preserving equipment for all passengers, especially children.

Families in the New York area are mourning the loss of the infant and her mother while awaiting further developments in both the criminal and immigration cases.
