The American Civil Liberties Union (ACLU) of Indiana has filed two lawsuits on behalf of the man, accusing the facility’s medical provider and correctional officers of failing to provide proper care and using unnecessary force.
Medical Emergency and Pepper-Spraying
The detainee, who relied on medication to prevent seizures, claims he missed critical doses while in custody and later suffered a seizure, hitting his head and requiring hospital treatment. Upon returning from the hospital, he was allegedly pepper-sprayed by officers through his cell door while still recovering.
The ACLU argues that these actions violated the detainee’s rights to medical care and protection from excessive force. ICE has denied claims of poor conditions at the facility, stating that detainees receive medical, mental health, and dental care.
