House Report Accuses NYC Prosecutors of Shielding Illegal Immigrants from Deportation

The Republican‑controlled House Judiciary Committee released a damning report on New York City’s district attorney offices, alleging that prosecutors across the Bronx, Queens, Manhattan, Brooklyn and Staten Island have been crafting plea agreements designed to prevent illegal immigrants from being deported. The committee, chaired by Rep. Jim Jordan (R‑Ohio), says internal documents show a coordinated effort to “immigration‑conscious” plea bargaining that leaves out key facts such as firearm references, victim relationships, and victim ages.

Bronx Office Under Scrutiny

Bronx District Attorney Darcel Clark, in office since 2016, is singled out for allegedly training prosecutors to conceal facts that would trigger removal proceedings. Internal memos reportedly instruct attorneys to omit any mention of firearms from conviction records and to charge non‑citizen defendants with “nonexistent, legally impossible” crimes—such as “attempted reckless assault”—so that a guilty plea does not expose them to ICE.

Similar Practices Across the City

State data from the Immigrant Defense Project show 289 convictions for attempted reckless assault citywide between 2015 and 2025, including 50 in the Bronx. Queens District Attorney Melinda Katz’s office is said to have sent an email in May 2026 describing a plea deal as “immigration safe” while still imposing jail time. In Manhattan, DA Alvin Bragg issued a 2022 memo urging prosecutors to seek dispositions that avoid immigration consequences for all misdemeanors and felonies, though his office later called the policy “outdated” and said it had been revised to give prosecutors discretion.

Sanctuary Policies and Federal Response

The report also highlights New York City’s sanctuary stance. Between July 2018 and June 2026, the NYPD declined 20,255 immigration detainers, and the Department of Correction refused 2,852 ICE requests. Notably, almost 10,000 of those detainers were filed in the last year of the second Trump administration, a period the report describes as far more aggressive than either the Biden era or the first Trump administration.

Federal Legislative Action

House Republicans are advancing legislation to curb sanctuary policies. The Shut Down Sanctuary Policies Act, which has stalled in the House, would prohibit state and local governments from limiting cooperation with federal immigration authorities. Committee members say the bill is essential to uphold law and order and to ensure victims receive justice.

Local Reactions

Staten Island District Attorney’s Office called the report “flagrantly false and patently political,” while emphasizing its commitment to prosecuting criminals before they are deported, citing Congress’s failure to secure the borders. The mayor’s office and the remaining DA offices have not responded.

Why This Matters for New Yorkers

For families and faith‑based communities that prioritize safety and the rule of law, the alleged practice of shielding illegal immigrants from deportation raises serious concerns. The Trump administration’s renewed focus on immigration enforcement underscores a national commitment to protect neighborhoods from criminal elements, regardless of immigration status. As the House moves forward with legislation to end sanctuary policies, New York City’s prosecutors may soon face new federal requirements that could reshape how local courts handle immigration‑related cases.
