FTC Enforces ‘Take It Down Act’ to Combat Nonconsensual Images

The Federal Trade Commission (FTC) has begun enforcing the ‘Take It Down Act,’ a significant step in protecting individuals from the unauthorized sharing of intimate images online. This federal law mandates that platforms and social media companies remove nonconsensual intimate images, including those generated by artificial intelligence, within 48 hours of receiving a valid request from the victim.

Empowering Victims

The law applies to both real images shared without consent and AI-generated fake images depicting real people. The FTC has also launched a new website, TakeItDown.ftc.gov, where victims can file complaints against platforms that fail to comply with the removal requests or do not provide a proper reporting process.

As the prevalence of AI-generated explicit images and sextortion scams continues to rise, this law offers victims more legal leverage than ever before. The National Center for Missing and Exploited Children reported a staggering 1,300% increase in cases involving generative AI images last year. Teenagers are particularly vulnerable to sextortion schemes, where criminals threaten to release intimate images unless victims pay a ransom.

Steps for Victims

Experts advise victims to take immediate action by taking screenshots, saving usernames, messages, and URLs, and reporting the content to the platform. Additionally, filing a complaint through the FTC’s website and contacting law enforcement is recommended, especially if minors are involved.

While the law may not completely eliminate the presence of these images on the internet, particularly on overseas websites, it represents a crucial step in providing victims with the tools needed to protect their privacy and dignity.
