Federal Civil Rights Office Launches Probe of Fayetteville School Discipline Policies

The U.S. Department of Education’s Office for Civil Rights (OCR) announced on August 18 that it is conducting a directed investigation into Fayetteville Public Schools. The probe will examine whether the district used race as a factor when deciding disciplinary actions for students, a practice the district says it does not employ.

Background and Federal Guidance

OCR’s investigation follows new federal guidance that stresses discipline decisions must be based on conduct, not race. The guidance, issued after a July 24 rule change that removed disparate‑impact provisions from Title VI regulations, warns schools against “racial balancing” – adjusting discipline merely to equalize outcomes across racial groups.

The department notes that racial disparities in suspension or referral data alone do not prove intentional discrimination, but schools may not intentionally treat students differently because of race.

District Response

Fayetteville Superintendent John Mulford and district communications director Alan Wilbourn said the district has never instructed staff to consider a student’s race when imposing discipline. Wilbourn explained that a 2021 state‑required disproportionality analysis was performed, but no policy directs staff to factor race into decisions.

“The discipline standard is the discipline standard. All students are expected to meet that standard,” Wilbourn said. “We were required by the state to do a disproportionality analysis, but we did not tell staff to use race when disciplining students.”

Next Steps

The OCR’s Kansas City Regional Office will collect and analyze district policies, procedures, and student handbooks. Fayetteville officials say they are cooperating fully and will provide the requested documents.

Assistant Secretary for Civil Rights Kimberly Richey said the new guidance “clarifies Title VI’s legal requirements and ends these harmful practices,” emphasizing the need for race‑neutral discipline policies.

Implications for Local Schools

While the investigation is ongoing and does not constitute a finding of wrongdoing, it underscores the federal focus on ensuring that school discipline is applied fairly and without bias. Local parents and community members will be watching closely as the district works to demonstrate compliance with Title VI.
