Fauci’s Fifth Amendment Refusal Sparks Contempt Proceedings

Dr. Anthony Fauci’s decision to invoke the Fifth Amendment over 100 times during a Senate hearing has sparked a legal showdown. Sen. Rand Paul, who chairs the Senate Homeland Security and Governmental Affairs Committee, plans to pursue contempt proceedings against Fauci.

Presidential Pardon and Fifth Amendment

Former President Joe Biden issued Fauci a full and unconditional pardon for all actions taken between Jan. 1, 2014, and Jan. 19, 2025. However, experts argue that this pardon may not provide complete protection for Fauci, as he could still face prosecution for lying under oath.

Abhishek Kambli, a former Justice Department official, stated that the issue presents a novel legal question about whether Fauci can invoke the Fifth Amendment at all. Kambli questioned whether the Fifth Amendment privilege properly applies if truthful testimony could no longer expose Fauci to prosecution for the underlying conduct.

Contempt Proceedings and Potential Consequences

Sen. Paul’s contempt resolution will move to the full Senate if it clears the committee. However, it will need to beat the 60-vote filibuster to pass. Fauci’s attorney, David Schertler, has not commented on the matter.

George Washington University law professor Jonathan Turley noted that the legal issues surrounding Fauci’s testimony are more complicated than either side suggests. Turley pointed out that Fauci’s decision to deliver an opening statement before invoking the Fifth Amendment could raise additional legal questions.
