Fairfax County jail transfers convicted illegal immigrant to ICE after high‑school assault case

FAIRFAX, Va. – The Fairfax County Sheriff’s Office transferred Israel Flores Ortiz, an 18‑year‑old illegal immigrant convicted of assaulting several female classmates at Fairfax High School, into the custody of U.S. Immigration and Customs Enforcement (ICE) on Monday. The move follows Ortiz’s sentencing to less than a year in prison and his release after serving roughly 140 days.

Conviction and sentencing

Ortiz was arrested on March 7 after multiple students reported that he had approached them in crowded hallways and grabbed them between the legs. A police investigation confirmed the assaults, leading to a trial in which Ortiz was found guilty on nine counts of assault and battery. In April, a Fairfax County judge sentenced him to a term of less than one year, but he received credit for time served and good behavior, resulting in his early release.

ICE detainer and transfer

According to the Department of Homeland Security, Ortiz entered the United States illegally in 2024. After his arrest, DHS issued a detainer, signaling that ICE should take custody once the state sentence was completed. The sheriff’s office complied, moving Ortiz into ICE custody on the scheduled release date of Sept. 3.

Community reaction

One victim told FOX 5, “There’s a lot of people to blame for what happened here, including schools, state law that allowed an adult man to attend school with 14‑year‑old girls. I’m glad to see there’s been some form of justice in a sense. He’s being removed but unfortunately it was too little too late.”

Virginia immigration‑policy advocates praised the transfer. “It’s heartening to see the sheriff’s department actively cooperate with ICE and observe they needed to transfer custody,” said Sean Kennedy of Virginia’s 4 Safe Communities. He noted that other jurisdictions have sometimes resisted ICE requests, but Fairfax County adhered to state law.

State immigration policy context

Virginia’s recent legislation has tightened state cooperation with federal immigration enforcement, requiring local law‑enforcement agencies to honor ICE detainers and share information about illegal immigrants who have committed crimes. Critics argue the laws threaten community trust, while supporters contend they protect public safety and uphold the rule of law.
