Washington — In a sweeping new legal opinion released Wednesday, the Justice Department’s Office of Legal Counsel warned that every state receiving federal aid for two major welfare programs must now report all illegal immigrants known to state agencies to the Department of Homeland Security. Failure to comply could trigger the loss of billions of dollars in funding.
What the opinion changes
Previously, only the specific state agencies that administered the Temporary Assistance for Needy Families (TANF) and Supplemental Security Income (SSI) programs were required to share immigration status information. The new guidance expands that requirement to any state agency that might have knowledge of an illegal immigrant’s presence— including universities, motor‑vehicle departments and other state offices.
Deputy Assistant Attorney General Joshua Craddock, who signed the opinion, said the 1998 rule “narrowed the scope of the 1996 Personal Responsibility and Work Opportunity Reconciliation Act by limiting the definition of ‘State’ to a single agency, rather than every agency within a state government.” The DOJ now interprets the law to require full cooperation from all state entities.
Why the administration is pushing this
Since taking office in January 2025, President Trump has made immigration enforcement a top priority, deploying agents to cities across the country and partnering with state and local law‑enforcement officials to locate violators. The administration argues that ensuring illegal immigrants do not receive federal welfare benefits protects American taxpayers and upholds the Constitution’s guarantee of limited government.

All 50 states, the District of Columbia and U.S. territories receive funding from TANF (over $16.5 billion annually) and SSI (more than $60 billion annually). Illegal immigrants are not eligible for either program, but the administration says that undisclosed presence of illegal immigrants in state systems could lead to improper payments.
State officials are now faced with the logistical challenge of gathering and transmitting data that many agencies have never been required to share. Some states, particularly those that issue driver’s licenses to illegal immigrants, may need to overhaul existing databases.

Democratic‑led states have already sued to block the Department of Homeland Security from accessing personal details of TANF recipients, arguing that the move violates privacy rights and federal‑state separation.
