Democratic states sue to block President Trump’s mail‑voting limit order

On Wednesday, roughly 24 Democratic‑controlled states filed a fresh lawsuit targeting President Trump’s executive order that seeks to limit mail voting for this year’s midterm elections. The suit, filed against the U.S. Postal Service, follows a recent Supreme Court decision that dismissed a prior challenge as premature.

Legal backdrop

The high court’s majority held the earlier Democratic lawsuit was untimely, but that ruling came before the administration issued a new rule governing how the Postal Service must handle mail ballots. Election officials warn the rule could be impossible to implement before the first wave of mail ballots is mailed next week.

State attorneys general’s response

New York Attorney General Letitia James, speaking for the coalition of 25 state attorneys general, said the federal government is attempting to “meddle” in state preparations and threaten Americans’ right to vote. She emphasized that the Postal Service lacks authority to decide who may vote by mail.

Current status of the order

Trump’s executive order remains blocked by a separate injunction, which the administration argues should be lifted in light of the Supreme Court’s recent ruling. The order also succeeded in a third case filed in May in the District of Columbia, where a judge found it premature to halt implementation.

Details of the new USPS rule

The rule requires states that want their mail ballots delivered to obtain federal approval of envelope designs and to provide the Postal Service with a list of eligible voters. National Democrats have cited this rule in a request to a federal judge in Washington to block the order, noting the administration had not taken concrete action when the order was first issued.

Judicial history

U.S. District Judge Indira Talwani in Boston, who previously issued an injunction against the order, found that the administration’s new rule violated that injunction, though she took no further action. The judge, appointed by former President Barack Obama, had blocked the order in an earlier case that the Supreme Court overturned.

Since returning to office, President Trump has repeatedly targeted mail voting, claiming it contributed to his 2020 loss—a claim the administration says is false.
