A dispute between a DeLand barbershop owner and the Florida Department of Transportation has moved to court. FDOT filed an eminent domain lawsuit seeking to acquire part of the property occupied by Bob’s Barber Shop as part of its Spring Garden Avenue improvement project.
Background
The lawsuit comes after negotiations between the state and the property owner failed to produce an agreement. Rick Haas, whose family has operated the business for decades, said he has always known the project would require part of his property. His concern is the amount the state has offered in compensation.
According to the lawsuit, FDOT is seeking to permanently acquire about 2,349 square feet of the property. The project would add a turn lane and other roadway improvements along Spring Garden Avenue, which FDOT says are needed to reduce traffic congestion and improve safety.
Haas said he understands the need for infrastructure improvements but believes the state’s offer doesn’t reflect the true value of the family business. He said relocating isn’t as simple as moving to another storefront because much of his customer base depends on the current location.
Court records show FDOT is asking the court to condemn the property, grant the agency possession before a final judgment is entered, and allow a jury to determine the amount of compensation if the parties cannot reach a settlement. Construction on the road is expected to begin fall 2027.
