Court Rules Against Trump-Era Ban on Transgender Military Service

A recent decision by a federal appeals court has struck down a policy from the Trump administration that banned transgender individuals from serving in the military. The U.S. Court of Appeals for the District of Columbia Circuit upheld a previous ruling by U.S. District Judge Ana Reyes, who found that the executive order likely violated constitutional rights.

The policy, introduced in January 2025, was part of an executive order signed by former President Donald Trump. It claimed that the sexual identity of transgender service members conflicted with military values and could negatively impact military readiness. Following this, Defense Secretary Pete Hegseth implemented a policy that presumptively disqualified individuals with gender dysphoria from serving.

Gender dysphoria is a condition where there is a conflict between a person’s assigned gender and their gender identity, often leading to distress and mental health challenges. The policy faced legal challenges from six active-duty transgender service members and two others seeking to join the military, leading to a preliminary injunction issued by Judge Reyes.

Appeals Court Decision

The appeals court’s decision, delivered by a divided three-judge panel, narrowed the injunction to apply only to those currently serving. Judge Robert Wilkins, writing for the majority, criticized the policy as being driven by a desire to harm a politically unpopular group. The ruling is a significant step in affirming the rights of transgender individuals to serve in the military without discrimination.
