Community groups sue to overturn Ocean City council’s rehabilitation designation for former Wonderland Pier site

Ocean City, N.J. – A coalition of community groups has taken legal action to challenge the city council’s recent designation of the former Gillian’s Wonderland Pier property as “in need of rehabilitation.” The designation, approved by the council in June, would allow the city to negotiate changes to the existing zoning that currently prohibits hotels on the waterfront parcel.

Legal challenge filed

The lawsuit, filed in the Atlantic County Superior Court, argues that the council’s decision was made without proper public notice and violates state statutes governing land‑use planning. Plaintiffs include the Ocean City Preservation Society, the local chapter of the New Jersey Homeowners Association, and several resident groups who say the move threatens the character of the historic boardwalk area.

Developer’s plans

Icona Resorts, the property’s owner, has announced plans to construct a luxury seven‑story hotel on the site. The developer says the project would bring new jobs, increase tourism revenue, and provide upscale accommodations for visitors to the popular shore town. The proposed hotel would be the first high‑rise hotel in Ocean City, a community that has traditionally limited large‑scale hospitality projects to preserve its family‑friendly atmosphere.

Zoning implications

Ocean City’s current zoning ordinance restricts the waterfront parcel to low‑rise residential and commercial uses, explicitly barring hotel development. By labeling the property as needing rehabilitation, the council creates a pathway to re‑zone the land, potentially allowing the hotel to be built. Opponents contend that such a change would set a precedent for future high‑rise projects that could alter the town’s historic skyline and strain local infrastructure.

Community response

Residents who signed the lawsuit expressed concern that the hotel would increase traffic, parking demand, and noise during peak summer months. “Our town’s charm comes from its modest scale and family‑oriented businesses,” said one Ocean City homeowner who asked to remain anonymous. “We fear a large hotel will erode that spirit and prioritize profit over community values.”

City council’s position

Mayor Jay D. Smith defended the council’s action, stating that the rehabilitation designation is a standard tool used by municipalities to address underutilized properties. “We are exploring all options that could benefit our economy while respecting the wishes of our citizens,” the mayor said in a recent press release. He added that any zoning change would still require a public hearing and a vote by the council.

Next steps

The court is expected to hold a preliminary hearing within the next 30 days to determine whether the lawsuit proceeds to a full trial. In the meantime, Icona Resorts has paused any construction activity pending the outcome of the legal process. Both sides have indicated a willingness to negotiate, but the core dispute—whether the rehabilitation designation was lawful—remains unresolved.

As the case moves forward, Ocean City residents and business owners will be watching closely, aware that the outcome could shape the future of development along the town’s beloved boardwalk.
