A police shooting in Colorado Springs, Colorado, has been ruled justified by the 4th Judicial District Attorney’s Office. The incident occurred on February 2 near the 2600 block of Bijou Street.
Details of the Incident
According to the DA, Officers Daniel Mork and Steven Milbert were on patrol in the area when they encountered a man, later identified as Michael Foster, who matched the description of a suspect connected to a murder and kidnapping case. Foster was wearing a mask on a warm afternoon, which Officer Mork believed he might have been using to conceal his identity.
After officers began to approach Foster on foot, he started running and ignored commands to stop. Foster then ran into an enclosed area, where he turned to face Officer Mork with a handgun. Both Officer Mork and Foster fired their guns, resulting in Officer Mork being shot in the leg and Foster being shot in his right arm.
Officer Milbert then entered the area, kicked Foster’s gun out of reach, and chased him. Foster attempted to grab Officer Milbert’s handgun, leading Officer Milbert to fire five shots at Foster, hitting him several times.
Foster was taken to the hospital, treated, and released into the custody of the El Paso County Sheriff’s Office. The DA found that both officers had reasonable grounds to believe Foster posed an immediate threat to themselves and others, justifying the use of deadly force.
