Casper police are accusing a 42-year-old man of sexually assaulting an unconscious woman at Pioneer Park in downtown Casper. The incident occurred on August 1, when an unknown caller reported two people having sex in the park across from the courthouse at 10:06 a.m.
Investigation Details
The responding officer found the suspect, Brian Sunrhodes, on top of the woman with his pants down and moving his hips. The woman was face-down on the cement and didn’t respond to police or paramedics, even after the suspect was detained. Both the woman and the suspect smelled of alcohol and were taken to the hospital.
Sunrhodes had a blood-alcohol concentration of 0.26%. He told police he thought he blacked out that day and hadn’t had sex recently. He said he was familiar with the woman and other people in the park that morning, and that they had been sharing a gallon of vodka.
Detective Aaron Trujillo wrote in the affidavit that the woman was still unresponsive at 3 p.m. He said it was unclear from the officer’s body cam footage whether Sunrhodes was fully engaged in intercourse.
Sunrhodes was charged with third-degree sexual assault and public indecency, a misdemeanor. A $50,000 cash or surety bond was set. He is presumed innocent unless found or pleading guilty.
