Camp Mystic seeks buyer to keep camp operating amid bankruptcy

Camp Mystic, a long‑standing youth camp in Texas, is moving forward with a Chapter 11 bankruptcy filing that includes a request for the court to give special consideration to bids that would keep the property functioning as a camp. The organization’s liquidation plan, filed on Friday, states its intent to sell “substantially all of its assets,” but it hopes a group of families and alumni will step forward with a purchase offer that preserves the camp’s historic mission.

Bankruptcy filing and the unusual request

Legal scholar Abigail Willie, an assistant professor of law at St. Mary’s University, called the request “highly unusual.” She explained that in typical bankruptcy auctions, the winning bid is determined solely by the highest monetary offer. “The question is never who does the debtor want to sell it to? That’s not relevant,” Willie said.

License hurdle

The Texas Department of State Health Services has already denied Camp Mystic a license to operate. Any prospective buyer would be required to reapply for a new license, adding a regulatory hurdle to the sale process.

How proceeds will be distributed

According to court filings, the proceeds from the land sale will be placed into a trust and then distributed to creditors. A significant portion of the money is expected to go to parents of children who died in a flooding incident at the camp. Those parents must first obtain judgments in state court to determine the camp’s liability for wrongful death. Any judgment amount that exceeds the camp’s insurance limits would be paid as a percentage of the remaining trust funds, based on the size of each claim.

Judicial approval required

The liquidation plan, including the special‑bid request, must still be approved by a bankruptcy judge. If the judge grants the request, families or alumni who submit a qualifying bid could acquire the land and continue operating the camp, preserving its legacy for future generations.
