Arizona Senate Leader Calls for More Oversight on ESA Program

Arizona Senate Majority Leader John Kavanagh has shifted his stance on the state’s Empowerment Scholarship Account (ESA) program, advocating for increased staffing to ensure proper oversight. This comes after revelations about the program’s vulnerabilities to mismanagement and fraud.

Concerns Over ESA Management

Initially, Kavanagh believed the Arizona Department of Education (ADE) was adequately staffed to manage the ESA program, which provides taxpayer-funded vouchers for private schooling. However, an Arizona Auditor General report highlighted significant gaps in the program’s internal controls, including automatic approvals of unauthorized purchases like amusement park tickets and hotel stays.

The report underscored that the ESA administration was operating with a minimal staff, often in ‘survival mode,’ leading to policy decisions such as automatically approving purchases under $2,000 to manage workload. This has raised concerns about the program’s ability to prevent waste and abuse effectively.

Calls for Reform and Accountability

Kavanagh, after reviewing the report, expressed his intention to consult with legislative attorneys to address these issues, potentially through budget amendments this session. He acknowledged the need for additional staffing at ADE to ensure proper oversight and accountability.

Despite these concerns, legislative efforts to introduce more stringent regulations have faced challenges. Democrats proposed over 20 bills this session aimed at enhancing accountability, but none received a hearing. Meanwhile, reform advocates like Kathy Boltz emphasize the importance of the Protect Education ballot initiative, which seeks to introduce academic testing and other safety measures.

Debate Over Fraud Claims

Kavanagh also questioned the extent of fraud within the ESA program, noting that Arizona Attorney General Kris Mayes has not pursued many fraud cases. He suggested that claims of widespread fraud might be overstated, given the limited number of prosecutions.

As discussions continue, the focus remains on ensuring that Arizona’s children have access to quality education through a well-managed and accountable ESA program.
