Arbitrator orders Washington Post to reinstate Black opinion writer

An independent arbitrator has ordered The Washington Post to reinstate Karen Attiah, the newspaper’s only Black full‑time opinion writer, after she was terminated for social‑media posts following the fatal shooting of conservative activist Charlie Kirk.

Arbitration ruling

Arbitrator Sarah Miller Espinosa found that the Post failed to demonstrate “gross misconduct” or sufficient cause for termination, violating the collective bargaining agreement with the newspaper’s union. The decision also mandates full back pay and restoration of lost benefits for Attiah.

Background of the dispute

Attiah, who served as the founding global opinion editor for the Post, posted several remarks on her Bluesky account after Kirk’s death. In one post she wrote, “Refusing to tear my clothes and smear ashes on my face in performative mourning for a white man that espoused violence is … not the same as violence.” Another post warned that the rush to “coddle violent white men” could provoke further violence.

The Post issued a termination letter on September 11, citing violation of its social‑media policy, alleged harm to the organization’s integrity, and potential endangerment of staff safety. The arbitrator concluded that these allegations did not meet the legal standard for dismissal.

Reactions

Attiah announced the ruling on Instagram, calling it a victory for journalists everywhere. The Democracy Defenders Fund and the Washington‑Baltimore News Guild, who represented her, hailed the decision as a landmark for press freedom, emphasizing that media companies cannot use retaliatory discipline to silence journalists addressing uncomfortable truths.

The Washington Post said it respects the arbitration process but declined further comment.

Broader context

The case has reignited debate over First Amendment rights after a wave of terminations and disciplinary actions across various professions related to commentary on Kirk’s assassination. The National Association of Black Journalists previously warned that Attiah’s firing highlighted the erosion of Black voices in the media and later gave the Post a “Thumbs Down Award” for its treatment of Black journalists.
