Albuquerque judge to rule on motion to dismiss Timothy Busfield indictment by Oct. 16

Albuquerque, N.M. – On Friday, Judge Joseph Montaño of the Second Judicial District Court heard a motion from the defense of director Timothy Busfield seeking to dismiss the grand‑jury indictment that accuses him of criminal sexual contact with two children during the production of a television series in Albuquerque between 2023 and 2024.

Defense alleges bias and withheld witnesses

Busfield’s attorneys argued that the state prosecution failed to disclose several witnesses before the grand jury, creating a bias that undermined the fairness of the indictment. The defense claimed the suppressed witnesses would have shown that the alleged contact was either consensual or mischaracterized.

State counters with procedural concerns

The state’s Office of the District Attorney responded that Busfield’s team attempted to introduce new witnesses without giving the prosecution adequate notice or time to prepare. Prosecutors said the defense’s late‑stage filings violated procedural rules and could prejudice the state’s case.

Judge Montaño did not issue a ruling during the hearing. He indicated that a written decision will be issued by Oct. 16, giving both sides additional time to submit briefs and address the court’s questions.
