Federal Judge Overturns Trump-Era Policy on Immigrant Visas

A federal judge has struck down a policy from the Trump administration that had frozen thousands of immigrant visas, affecting individuals from 39 countries across Africa, Asia, Latin America, and the Middle East. This policy, enacted following a shooting incident involving National Guard members, had placed many immigrants in a state of legal uncertainty.

Judge’s Ruling

U.S. District Chief Judge John McConnell Jr. criticized the U.S. Citizenship and Immigration Services (USCIS) for overstepping its authority and acting without proper justification. He stated that the policy was contrary to law, arbitrary, and capricious, accusing the agency of using national security concerns as a pretext for anti-immigrant sentiments.

The policy had categorically barred immigrants from receiving final decisions on applications for asylum, work permits, green cards, and citizenship. Judge McConnell emphasized that the federal government cannot lawfully shut down immigration pathways or discriminate based on nationality.
