Employees have reported concerns about favoritism, a lack of fairness, and fear of retaliation. Auditor Maestas emphasized the urgent need for corrective action, stating that the people of Doña Ana County deserve a government that operates with integrity and accountability.

The audit also highlighted financial mismanagement, with Maestas noting that the county has been careless with public funds. This has prompted a report to the state attorney-general regarding violations of the Inspection of Public Records Law, with a lawsuit already filed by Yoli Diaz alleging multiple breaches.

Conflict with Sheriff Stewart

The audit also sheds light on a long-standing dispute between county management and Sheriff Kim Stewart. The report criticizes county interference in law enforcement matters, particularly regarding the evaluation and dismissal of police cadets. The auditors supported Sheriff Stewart’s stance that the sheriff should have the authority to make decisions based on evaluations by state-certified psychologists, rather than being overruled by county HR.

This interference has created legal and operational risks, with potential lawsuits looming if cadets are wrongly denied accreditation or if unsuitable candidates are hired against psychological advice. The audit also noted that the county initially did not allow for appeals in these matters until Sheriff Stewart demanded it, leading to further legal disputes.
