Texas Public Information Act and Free Speech Spotlighted at Austin Conference

On Sept. 18, the Freedom of Information Foundation of Texas (FOIFT) will convene in Austin for its annual state conference, “Tracking the Truth, Safeguarding First Amendment Rights.” The event places the Texas Public Information Act and free‑speech protections at the forefront of discussion, underscoring their importance for everyday Texans who rely on transparent government.

Conference agenda emphasizes transparency and speech

The opening session will focus on free expression on college campuses, featuring former KUT News general manager Debbie Hiott. Hiott’s recent dismissal by the University of Texas at Austin sparked a controversy that many see as a test of both free‑speech rights and the state’s transparency laws.

Other speakers include First Amendment experts, a panel on accessing immigration‑enforcement information, and a keynote address by Garrett Haake, chief White House correspondent for NBC News. A dedicated session will walk attendees through practical use of the Texas Public Information Act.

Why the Public Information Act matters

Enacted 53 years ago, the Texas Public Information Act was designed to presume that government records are open to the public unless a specific legal exemption applies. This presumption empowers citizens to request information about how taxpayer dollars are spent and how officials make decisions.

Under the law, a governmental body that wishes to withhold records must justify its decision, often by seeking a ruling from the Texas Attorney General’s Office. The attorney general’s oversight helps prevent officials from unilaterally deciding what the public may or may not know.

Challenges and proposed reforms

Critics note that some agencies delay releases, request costly estimates, or misuse attorney‑client privilege and litigation exemptions to block disclosure. FOIFT argues that the Act needs stronger enforcement mechanisms. One proposal is to allow requestors who go to court to recover their legal fees from the government agency—a safeguard that is not currently guaranteed in Texas.

The organization urges the state Legislature to address these gaps during its 2027 session, calling for a “back‑to‑basics” approach that restores the Act’s original intent: to give citizens the tools to watch over public servants and public funds.
