GOP Oversight Chairman James Comer Introduces Survivor’s Voice Protection Act to Void NDAs

In a move aimed at safeguarding the rights of abuse survivors, House Oversight Committee Chairman James Comer announced the Survivor’s Voice Protection Act on Tuesday. The legislation would make any nondisclosure agreement (NDA) clause that prevents a victim from sharing information about sexual abuse void and unenforceable, applying to both new and existing agreements.

Why the Bill Matters

Comer said the proposal grew out of revelations uncovered during the ongoing congressional investigation into the late Jeffrey Epstein’s network of sexual exploitation. “During our investigation, we’ve learned how powerful men weaponized nondisclosure agreements to silence survivors of sexual abuse,” he told CNN’s Jake Tapper. “The Survivor’s Voice Protection Act ensures individuals with information about sexual abuse and survivors can speak freely about these crimes, despite any nondisclosure agreements.”

Key Provisions

  • Any NDA provision that would stop a victim or any other person from providing information about sexual abuse becomes null and void.
  • The rule applies retroactively, affecting existing contracts as well as future agreements.
  • The bill adds a federal definition of “grooming” for the first time and requires mandatory reporting of grooming of a minor to law‑enforcement agencies.

These provisions aim to empower victims, hold abusers accountable, and give law‑enforcement a clearer tool to intervene before abuse escalates.

Bipartisan Support and Legislative Outlook

While the bill enjoys broad bipartisan backing for its accountability goals, its ultimate fate in the House remains uncertain. Lawmakers from both parties have expressed enthusiasm for protecting survivors, though they differ on the best mechanisms for implementation.

The legislation arrives amid a high‑profile standoff between the Oversight Committee and billionaire investor Leon Black, a key witness in the Epstein probe. Black refused to appear before the committee on September 3 and sued to block the release of NDAs he allegedly signed. The committee voted unanimously to hold him in contempt of Congress for refusing to turn over the agreements and to appear for a deposition.

Context of the Epstein Investigation

Black is among numerous wealthy individuals whose connections to Epstein have come under renewed scrutiny following the Justice Department’s release of millions of Epstein‑related files. In a closed‑door interview in June, Black told members of Congress he was unaware of the full scope of Epstein’s crimes and denied any personal involvement in sexual abuse or relations with minors.

What This Means for Survivors

If enacted, the Survivor’s Voice Protection Act would give victims a clear legal pathway to speak out without fear of contractual retaliation. It also signals a broader congressional commitment to confronting sexual exploitation and protecting the most vulnerable, especially minors, from grooming and abuse.

Supporters argue the bill aligns with core American values of individual liberty and personal responsibility, ensuring that powerful individuals cannot use private contracts to evade accountability. Critics, primarily from civil‑liberties groups, caution that the legislation could raise privacy concerns for third parties mentioned in NDAs. Nonetheless, the bill’s sponsors maintain that the public interest in exposing abuse outweighs any potential inconvenience.

Next Steps

The bill now heads to the full House for debate and a vote. If passed, it would move to the Senate, where similar bipartisan momentum could carry it forward. For now, survivors and advocates are hopeful that the legislation will become law, providing a vital tool to break the silence that has long protected abusers.
