Texas Senate hopeful Talarico’s 2019 remarks on parental rights spark renewed controversy

In a hearing before the Texas House Committee on Family and Protective Services in 2019, James Talarico – now the Democratic candidate for U.S. Senate in Texas – warned that parents who deny a child’s gender identity could be engaging in harmful, even abusive, behavior. “I think there are some folks that would think that if you deny your child’s gender identity, that’s incredibly harmful. And whether or not we label it with the term abuse, it’s abusive for sure,” Talarico said.

Legislative context

The remarks were made while discussing House Bill 1910, legislation intended to prevent courts from labeling a parent’s refusal to affirm a child’s gender identity as child abuse in custody determinations. The bill’s text states that a court “may not consider evidence regarding whether the party demonstrates a history or pattern of acknowledging or declining to acknowledge the child’s gender identity or expression.”

Talarico opposed the bill, arguing that a blanket rule could endanger vulnerable children. “My concern is ruling it out as not being abuse, I think, is dangerous and could certainly harm some of our most vulnerable kids in the state,” he explained.

Backlash and political fallout

Republican officials have seized on the comments. Zach Kraft, a spokesperson for the Republican National Committee, called Talarico “a truly sick individual for dedicating his life to pushing sex changes on other people’s kids.” The language reflects the heated partisan divide over how Texas should handle pediatric gender treatments and parental authority.

Although the original version of HB 1910 died in committee, a stronger version passed the Texas House in May 2025 and became law. Talarico voted against that measure, joining 58 other lawmakers in opposition. He also supported an amendment to sunset the law in 2030 and backed a separate amendment that explicitly labeled “rejecting a child’s gender identity or sexual orientation as abuse.”

Campaign response

When asked about the resurfaced clip, Talarico’s campaign emphasized his support for parental decision‑making. “James believes parents have the most important say in decisions about their children, which is why he sponsored a bill to protect parental rights and ensure parents are responsible for the upbringing of their own kids,” campaign spokesperson JT Ennis said. The statement also contrasted Talarico’s stance with that of Attorney General Ken Paxton, accusing Paxton of endangering families by “allowing pedophiles back on our streets.”

What this means for voters

The controversy underscores the broader cultural battle playing out in Texas politics. While many conservatives view any acknowledgment of pediatric gender treatments as an overreach of government, some progressive groups argue that protecting transgender youth is a matter of civil rights. For Texas voters, the issue may become a litmus test for how candidates balance parental rights, child welfare, and evolving social norms.

As the Senate race heads into the primary season, Talarico’s past statements are likely to be a focal point for both supporters and opponents. Voters will need to weigh his broader policy platform – including his positions on policing, border security, and economic growth – against the concerns raised by his comments on gender identity and parental authority.
