Louisiana public defender offices face budget shortfalls, audit shows

Louisiana’s public defender system is confronting a persistent funding crunch, according to a new report from the state Legislative Auditor released Monday. The audit found that 12 of the 42 local public defender offices overspent during fiscal year 2024‑25, though each retained enough reserve funds to cover the deficits.

Jefferson Parish office leads overspend

The 24th Judicial District, which serves Jefferson Parish, posted the largest shortfall, spending roughly $1 million more than it collected for the fiscal cycle that ended June 30, 2025. While the office’s reserves absorbed the loss, the figure underscores the broader financial instability facing public defense across the state.

Funding sources and shortfalls

The audit shows the state contributed just under half of the $79.8 million total spent by public defender offices in FY 2024‑25. The remainder came primarily from local sources, including conviction and user fees. Historically, a $45 fee assessed when a defendant is convicted or pleads guilty has been a major revenue stream, but that fee’s collections have declined and can vary dramatically from year to year.

District attorneys in several jurisdictions have also introduced diversion programs for traffic citations. These programs allow violators to avoid a conviction—and the associated public defense fee—by paying prosecutors for an alternative resolution that may protect auto‑insurance rates or reduce fines.

State defender calls for stable funding

State Public Defender Rémy Starns attributes the fiscal challenges to “the unstable, inadequate and insufficient nature of our primary funding stream,” which has forced many districts into deficit spending each year. In an August 20 written response to the auditor’s findings, Starns said he will again press the legislature in 2027 for a funding formula that ties public defender appropriations to any increase in district‑attorney funding.

Earlier this year, Starns introduced legislation that would have guaranteed automatic funding increases for public defenders whenever district‑attorney budgets rose. The proposal stalled amid concerns that lawmakers would lose control over annual public‑defense spending levels.

Audit recommendations and next steps

The auditor recommended that the Office of the State Public Defender closely monitor local offices to ensure reserve funds do not fall below 15 percent of annual expenditures. Starns agreed to implement the recommendation and noted that additional staff have been hired to track district‑office spending more rigorously.

Other districts that exceeded their budgets in FY 2024‑25 include offices covering Allen, Caddo, Bienville, Bossier, Cameron, Claiborne, East Feliciana, Evangeline, Franklin, Iberia, Jackson, Richland, St. Bernard, St. Martin, St. Mary, Webster, West Carroll, and West Feliciana parishes. Some of these offices serve multiple parishes.

Looking ahead

While the audit highlights ongoing fiscal strain, the presence of reserve funds in overspending districts suggests that the system has not yet reached a crisis point. Nonetheless, state officials and local defenders alike agree that a more reliable and predictable funding structure is essential to maintain effective representation for Louisiana’s indigent defendants.
