Mother charged with capital murder after two children found in burning car

San Antonio police and Child Protective Services are investigating after two children were found dead in a burned vehicle; the mother, identified as Marlene Vidal, faces capital murder and arson charges. The children, believed to be ages 5 and 7, were discovered just before 5 a.m. Friday behind a warehouse in the 500 block of Richland Hills Drive near Potranco Road in Bexar County. SAPD Assistant Chief Jesse Salame noted mental health may be a factor as the probe continues, and officials confirm CPS had prior involvement with the family.

The case unfolded when officers found the vehicle on fire and the two children inside. Marlene Vidal, 34, was arrested and booked into the Bexar County Adult Detention Center. Court records show she is held on two counts of capital murder and one count of arson, with a combined bond set at $2.1 million.

Child Protective Services verified it had been involved with the family, but agency spokespeople declined to offer specifics while their investigation remains open. CPS plans to release a child fatality report when the review is finished. That report will be closely watched by advocates and neighbors who are trying to understand how this escalated to tragedy.

Authorities say Vidal is originally from Edinburg in the Rio Grande Valley and had stayed with relatives in San Antonio at times. Edinburg police confirmed they encountered Vidal days before the children were found but said there was no basis to arrest or detain her then. “The Edinburg Police Department is aware of the tragic case in San Antonio,” the department said.

SAPD Assistant Chief Jesse Salame said investigators have not publicly identified a motive but that mental health could have contributed to what happened. The children have not been publicly identified. Neighbors and relatives in both San Antonio and Edinburg are trying to piece together where the family had been living and what supports were in place.

Public records show a civil case between Vidal and the children’s father filed under a parent and child relationship category, though those court documents were not immediately available for review. Legal filings like that often involve custody, child support, or supervised visitation, which can signal ongoing family stress even when the details are private. Child welfare experts say such records can raise red flags but don’t always lead to emergency action without clear evidence of imminent danger.

Attorney Joseph Hoelscher commented on the limits officers face when mental health is involved, saying, “First, most officers are not well-trained to respond as mental health professionals, but also, their authority is somewhat limited in Texas because we don’t have any type of red flag law,” said attorney Joseph Hoelscher. He added that without explicit signs of immediate risk, officers may not have legal grounds to detain someone for evaluation, which complicates prevention efforts.

The investigation spans local jurisdictions. Because the alleged crime occurred in Bexar County, local CPS and San Antonio police are leading the inquiry. Hidalgo County and Edinburg records were checked for any past criminal history, and officials say Vidal has no prior criminal history in Bexar or Hidalgo counties, although the recent Edinburg contact is now part of the review.

Community response has been quiet and heavy, with a vigil held by neighbors seeking answers and comfort for grieving relatives. Local leaders and child welfare advocates are raising questions about whether more could have been done after the earlier encounters and what safety nets are missing for families in crisis. For now, the legal process will move forward while investigators piece together timelines and contacts leading up to the deaths.

The public and professionals involved in the case say they hope lessons from this investigation will highlight gaps in response and prevention so other families do not face the same heartbreak.
