Supreme Court to Hear Case on Asset Forfeiture

The Supreme Court has agreed to hear the case of Kenneth Jouppi, an 82-year-old Alaska man who is challenging the state’s effort to confiscate his plane over a six-pack of beer. In 2012, Jouppi was operating a one-man air taxi service when state troopers found a six-pack of beer on board his plane. Although having beer on the plane was not illegal in itself, Jouppi was convicted of alcohol importation, a misdemeanor, because the destination village had banned the possession or sale of alcohol.

Asset Forfeiture at Stake

The Alaska Supreme Court ruled that the state was required to confiscate Jouppi’s plane, valued at $95,000, under the alcohol importation ban. Jouppi argues that the seizure of his plane violates the 8th Amendment’s ban on excessive fines. The Supreme Court’s decision in this case could have significant implications for the ability of state and local governments to impose asset forfeiture, a practice that has been criticized by civil libertarians.

The case has drawn attention from scholars and advocates who argue that the court’s ruling could help to rein in the use of asset forfeiture, which can be used to generate revenue for governments. The Cato Institute, a libertarian think tank, has filed a brief in support of Jouppi, arguing that the court should consider the original understanding of the 8th Amendment’s ban on excessive fines.

Alaska, on the other hand, argues that confiscating the planes of those who facilitate illegal imports is necessary to prevent the problems caused by alcoholism in the state’s remote regions. The state claims that airplanes are often the only means of accessing these areas, and that forfeiture is necessary to remove the tools used to commit crimes.

The Supreme Court’s decision in this case is expected to be closely watched, as it could have significant implications for the balance of power between law enforcement and individual property rights. Oral arguments are likely to take place later this year or early next year, with a decision expected by next summer.
