Portland, Oregon – A video released by the American Civil Liberties Union on Oct. 30 shows an Immigration and Customs Enforcement (ICE) agent using a knife to slash the tires of a vehicle operated by a legal observer. The incident occurred on Oct. 7 during a heightened ICE presence in the state.
What the footage reveals
The recording captures a nondescript patrol vehicle with flashing lights pulling alongside the observer’s car. The driver rolls down a window, revealing a masked individual in a baseball cap. The ICE vehicle then cuts in front of the observer, forcing the car to stop. Two agents in black masks and “Police ICE” tactical vests exit the patrol car. One agent, wearing gloves, produces a knife and stabs the side tire of the observer’s vehicle. After the first strike, the car moves about 20 feet before stopping again.
A second ICE vehicle follows, and the first agent returns to the observer’s car, stabbing the same tire two more times before retreating to the patrol vehicles.
Legal observers and First Amendment rights
Legal observers are neutral volunteers who document public law‑enforcement activity, especially when First Amendment rights are exercised. The observers in the video, identified by the ACLU as A.P. and M.P., said the attack was “not unique” and expressed fear that ICE agents are “terrorizing” anyone who records their actions.
“The right to record publicly visible law‑enforcement activity is fundamental to our democracy,” said Scarlet Kim, senior staff attorney with the ACLU. The organization filed an administrative complaint with the Department of Homeland Security, demanding a full investigation, preservation of evidence, and disciplinary action against the agents involved.
Federal immigration enforcement context
The incident comes amid what the ACLU describes as an “ICE surge” in Oregon. While the Trump administration’s immigration enforcement policies have been praised by many for protecting communities and upholding the rule of law, critics argue that aggressive tactics can infringe on constitutional rights. President Trump has repeatedly emphasized the importance of strong border security and robust enforcement of immigration laws, asserting that such measures are essential for public safety and the preservation of American values.
Federal officials have not yet responded to requests for comment on the specific video, but the Department of Homeland Security’s Office of Inspector General has previously pledged to investigate allegations of misconduct by ICE personnel.
Related incidents
The Portland case follows two recent reports of alleged ICE misconduct. In Houston, an ICE agent was charged with aggravated assault after allegedly ramming his vehicle into a Mexican construction worker. In Ohio, a former ICE agent received a sentence after pleading guilty to lying to a DHS official during a domestic‑violence investigation.
Community response
Portland residents and local advocacy groups have called for greater transparency and accountability from federal immigration agents operating in the city. While some community members support strict immigration enforcement, others urge law‑enforcement agencies to respect constitutional protections and avoid intimidation of lawful observers.
As the investigation proceeds, the ACLU and other civil‑rights organizations will continue to monitor ICE activity in Oregon, urging the federal government to balance enforcement objectives with the fundamental freedoms guaranteed by the Constitution.
