New Mexico judge orders education department to fix plan gaps by March 2027

SANTA FE — A New Mexico judge has found that the state’s nearly 200‑page remedial education plan does not fully satisfy court‑ordered requirements and ordered the Public Education Department (PED) to submit a supplemental plan by March 26, 2027. The deadline comes as Governor‑elect Deb Haaland prepares to assume office in January, placing the education reform effort squarely on the incoming administration’s agenda.

Judge’s findings

First Judicial District Judge Matthew J. Wilson issued a 39‑page order on Nov. 2 in the consolidated Yazzie/Martinez lawsuit, which began in 2014 after families and school districts alleged that New Mexico failed to provide a constitutionally adequate education to Native American students, English learners, students with disabilities, and low‑income students. While the judge acknowledged that PED’s November 2025 plan addressed several court‑mandated items, he identified a number of critical gaps.

Specifically, Wilson said the plan did not clearly explain how it would achieve smaller class sizes, expand summer school programs to prevent learning loss, improve teacher evaluation systems, or fund textbooks. He also criticized the plan’s organization, noting that its structure makes it difficult to match proposed actions with the specific constitutional violations identified in earlier rulings.

What the court requires

PED must now prepare a supplemental filing that explicitly links each proposed remedy to the corresponding court order and constitutional violation. The department must also outline how it will measure progress and determine when each action is completed. Failure to comply could result in sanctions, Judge Wilson warned.

The plaintiffs have until April 23, 2027 to object to the supplemental filing. While they argued that the original plan lacked enforceable commitments, clear implementation strategies, sufficient funding analysis, and meaningful participation from affected communities, the judge declined to require a complete rewrite. He noted that the plan already contains general metrics, goals, and benchmarks that extend through 2028.

Reactions from advocacy groups

The New Mexico Center on Law and Poverty, which represents the Yazzie plaintiffs, welcomed the finding that the plan is incomplete but expressed disappointment that the court did not require broader collaboration or a comprehensive resource analysis. Melissa Candelaria, the center’s education director, said the incoming administration has an opportunity to forge a lasting solution grounded in the expertise of students, families, tribal governments, educators, and communities.

Regis Pecos, chair of the Tribal Education Alliance, and Loretta Trujillo, executive director of Transform Education New Mexico, echoed the call for greater cooperation with tribal governments and families. Trujillo highlighted that “thousands of New Mexico students have continued moving through our public schools without seeing the changes and resources they were promised.”

Implications for the new administration

Governor‑elect Haaland’s team will inherit a complex education reform agenda as they begin their first legislative session. The March deadline aligns with the start of the 2027 legislative session on Jan. 19, meaning the supplemental plan will be a key item for lawmakers to consider.

While the court declined to dictate detailed budgeting or dictate state funding decisions, it reaffirmed the constitutional separation of powers among the judicial, legislative, and executive branches. This leaves the upcoming administration and the state legislature responsible for allocating resources and shaping policy to meet the court’s standards.

Background of the litigation

The Yazzie/Martinez litigation began in 2014, alleging that New Mexico’s public‑school system failed to provide an education sufficient to meet constitutional guarantees for disadvantaged students. In 2018 the court found the state in violation of those rights, and a final judgment followed in 2019. Subsequent orders, including a May 20, 2025 directive, required the state to develop a comprehensive remedial action plan. PED submitted its revised plan on Nov. 3, 2025, describing it as a coordinated approach to improving instruction, educator preparation, student services, and accountability.

Judge Wilson’s latest order does not invalidate those efforts but underscores that additional work is needed to fully satisfy the court’s earlier requirements.

Next steps

PED is expected to file the supplemental plan soon, linking its original proposals to the identified gaps. The upcoming administration will need to evaluate the plan, work with legislators, and ensure that resources are directed toward smaller class sizes, effective summer programs, robust teacher evaluations, and adequate textbook funding. Stakeholders, including tribal leaders, parents, and educators, will be watching closely to see whether the state can translate its commitments into measurable improvements for New Mexico’s students.
