Mobile judge dismisses stolen‑property charge against former death‑row inmate

Mobile County Circuit Judge Vicki Davis on Thursday dismissed a charge of receiving stolen property against William John Ziegler, 51, of Mobile. The charge stemmed from a stolen boat incident in 2023, but the defense argued that Ziegler could not be convicted of the offense because he had already served time for a related theft conviction in Mississippi.

Legal background

Ziegler’s legal saga began with a capital‑murder conviction for the 2000 stabbing death of Russell Allen Baker Jr. at the Peach Place Inn apartments. In 2013, then‑Mobile County Circuit Judge Sarah Stewart, now chief justice of the Alabama Supreme Court, ruled that Ziegler’s original defense counsel had provided ineffective representation. Stewart threw out the murder conviction, and Ziegler later entered a guilty plea to murder as part of a deal that allowed him to finish his prison term with time served.

Following the overturn, Ziegler was sentenced in Mississippi for the theft of the same boat involved in the 2023 charge. He has been on parole since completing that sentence.

Judge Davis’ decision

During the hearing, defense attorney Jeff Deen cited a 1980 Alabama Court of Criminal Appeals decision, asserting that a person cannot be convicted of receiving stolen property when they have already been convicted and served a sentence for the underlying theft. “Judge Davis kind of questioned the judicial – best word to put it – judicial economy of doing that,” Deen told FOX10 News. “He’s already done three years in prison. He’s on parole. It was beating a dead horse, and the prosecutor wisely decided to go ahead and dismiss the case.”

Judge Davis agreed that pursuing the charge would serve little purpose, noting that Ziegler had already faced significant incarceration and was under parole supervision for the Mississippi conviction.

Impact on Ziegler

With the stolen‑property charge dismissed, Ziegler will remain on parole for the Mississippi theft conviction but will not face additional jail time in Alabama for the boat case. The decision underscores the court’s willingness to consider judicial economy and the principle that individuals should not be punished multiple times for the same conduct.

Broader context

The case highlights ongoing concerns about the effectiveness of legal representation in capital cases. Judge Stewart’s 2013 order, which detailed numerous failures by Ziegler’s original attorneys—including the loss of key evidence that could have implicated a co‑defendant—remains a landmark example of the justice system correcting past errors.

Local advocates for criminal‑justice reform have pointed to Ziegler’s experience as evidence that the system can, at times, rectify wrongful convictions and excessive sentencing. While the dismissal does not erase the original murder conviction, it does prevent an additional, arguably redundant, prosecution.

What’s next?

Ziegler will continue to comply with the terms of his parole, which include regular check‑ins with a parole officer and any conditions imposed by the Mississippi court. The Mobile County District Attorney’s Office has not indicated whether it will pursue any further action related to the boat theft.

Residents of Mobile and surrounding areas can follow updates on this case through local court filings and news outlets.
