Hoover City Council Approves Sale of Novelty Fireworks and Sparklers

The Hoover City Council has voted to modify the city’s fireworks ordinance, permitting the sale and use of certain “novelty” fireworks and sparklers that are non‑explosive and non‑aerial. The change brings Hoover’s regulations into alignment with a 2021 state insurance office and fire marshal exception, and follows similar moves by neighboring cities such as Huntsville.

What is now allowed

Under the new ordinance, items such as party poppers, snappers, toy snakes, glow worms, wire sparklers and dipped sticks may be sold and used within city limits. The definition of a sparkling device limits each tube to 75 grams or less of chemical compound, or a total of 500 grams for multiple tubes. Devices must be handheld or ground‑based, non‑explosive, and non‑aerial.

What remains prohibited

Traditional fireworks that detonate or explode remain illegal without a special permit. This includes firecrackers, skyrockets, bottle rockets, reloadable shell devices, Roman candles, single‑tube devices with reports, aerial devices, audible ground devices, and any item that could explode.

Permit and sales requirements

Novelty fireworks may only be sold during two holiday windows: the Fourth of July season (June 20 – July 10) and the New Year’s season (December 15 – January 2). Sales must occur in a permanent building equipped with an automatic sprinkler system and inspected by the fire marshal both before and after the merchandise is placed on the shelves. Temporary trailers are expressly prohibited.

The selling space cannot exceed 400 square feet, must not be near a window where sunlight could ignite the items, and must be at least 50 feet from any ignition source such as cigarettes, pipes or cigars. After the holiday period, any unsold novelty fireworks must be removed by the wholesaler or distributor; they cannot be stored on the premises.

Public‑safety perspective

Hoover Fire Chief Clay Bentley explained that the state‑level exception was crafted to give residents a safe, controlled way to enjoy small fireworks while protecting public safety. “There’s inherent danger in anything people do, whether owning a handgun or driving a car,” Bentley said. He emphasized that the end user is ultimately responsible for proper use and clean‑up to prevent accidental fires.

Chief Bentley noted that other Alabama cities, including Huntsville, have already adopted similar rules. “We’re in favor of this for now,” he said, adding that the mayor and city officials will monitor the program and rescind it if problems arise.

Community impact

Local businesses that meet the permitting criteria will have a new seasonal revenue opportunity, while families gain a legal, low‑risk option for holiday celebrations. The ordinance balances the desire for festive traditions with the city’s commitment to safety and responsible fire‑code compliance.

Residents with questions about the new rules are encouraged to contact the Hoover Fire Department or visit the city’s official website for detailed guidelines and permit applications.
